• Mwalimu Assistant: Our AI-powered tool that provides educational assistance and support for teaching-related tasks.
• Premium Services: Paid features, subscriptions, or enhanced access on Mwalimu Plug.
• Third-Party Services: External websites, applications, payment systems, or services that Mwalimu Plug may link to or use.

3. Eligibility

Mwalimu Plug is designed for teachers, educators, and education professionals in Kenya. Anyone may use the Platform, but you must be capable of entering into a binding agreement under applicable Kenyan law.

If you are under the age of 18, parental or guardian consent may be required in some circumstances. By using Mwalimu Plug, you represent that you have the necessary rights and authority to accept these Terms.

4. User Accounts

When you create an account on Mwalimu Plug, you agree to:

• Provide accurate, current, and complete information
• Keep your login credentials and password strictly confidential
• Accept responsibility for all activity conducted through your account
• Not impersonate another person or create accounts under false identities
• Not allow anyone else to use your account without permission

Mwalimu Plug may suspend, restrict, or terminate your account if we have reasonable grounds to believe you have breached these Terms, engaged in fraud, posed a security threat, or violated applicable law. Where we take such action, we will endeavor to notify you of the reason, except where security considerations prevent this.

• Lesson plans, schemes of work, and teaching notes

• Education news and updates relevant to Kenya's education sector
• Teaching job listings and career opportunities
• Ability to save and organize resources and opportunities
• Notifications about new content and opportunities
• AI-powered assistance for educational tasks
• Other teacher-focused digital tools and features

Mwalimu Plug is provided on an "as available" basis. We may change, improve, add, suspend, or discontinue features or services at any time without prior notice. We do not guarantee that every feature will remain available indefinitely or that the Platform will be suitable for every purpose.

6. Educational Resources

Educational materials on Mwalimu Plug are provided to support teachers and educators in their professional work. You may use these resources for legitimate educational and professional purposes subject to applicable copyright and licensing restrictions.

You must not:

• Upload or share content you do not have the legal right to share
• Deliberately infringe copyright or intellectual property rights
• Misrepresent another person's work as your own
• Use resources to distribute illegal or harmful material
• Abuse download systems or attempt to bypass access restrictions
• Use resources for commercial purposes without appropriate authorization

Where educational resources originate from third parties, ownership and copyright may remain with their respective owners. Mwalimu Plug does not necessarily own every resource displayed on the Platform. Where you use third-party material, you are responsible for respecting the original author's or publisher's rights.

7. User-Submitted Content

If Mwalimu Plug allows you to submit content—including comments, files, reviews, feedback, or other material—you agree that you have the legal right to share such content and that you will not submit content that:

Mwalimu Plug does not guarantee that every news report is completely accurate, current, or free from errors. News sources may occasionally contain outdated information, differing perspectives, or unverified claims. For important decisions or information, you should verify details from authoritative sources such as the Ministry of Education, Kenya National Examinations Council (KNEC), or official government statements.

9. Jobs and Opportunities

Mwalimu Plug may display teaching jobs, vacancies, recruitment opportunities, professional development programs, or other opportunities from third-party organizations and employers. Important points about job listings:

• Mwalimu Plug is not necessarily the employer and does not post all job listings on behalf of employers.
• Publishing a job listing does not constitute an endorsement of the employer or guarantee of employment.
• You should verify job details directly with the employer before applying.
• Exercise appropriate caution when sharing personal information with potential employers.
• Mwalimu Plug is not responsible for employment decisions, hiring practices, or conduct of employers.
• Mwalimu Plug does not verify every employer or job listing. You are responsible for determining the legitimacy of opportunities.

Mwalimu Plug may direct you to an employer's website or external application process. Once you leave Mwalimu Plug, you are subject to that third party's terms and privacy practices, which are beyond our control.

10. Mwalimu Assistant and AI Features

Mwalimu Assistant is an AI-powered tool designed to help educators with teaching-related tasks. You may use it to request help with:

• Lesson planning and lesson structure
• Creating schemes of work and term plans
• Generating exam questions and assessment materials
• Developing marking schemes and rubrics
• Creating teaching notes and instructional materials
• Curriculum-based education (CBC) and competency-based education (CBE) planning
• Research, information, and general educational questions
• Other educational assistance and advice

Mwalimu Assistant is powered by artificial intelligence and has important limitations you should understand:

• ACCURACY: AI-generated content may contain errors, omissions, outdated information, or inaccurate suggestions. We do not guarantee accuracy.
• CURRICULUM COMPLIANCE: AI responses may not always align with current Kenyan curriculum requirements. You should verify that suggested content meets your actual teaching context.
• YOUR RESPONSIBILITY: You are responsible for reviewing, verifying, and editing all AI-generated material before using it professionally or academically.
• PROFESSIONAL JUDGMENT: Do not rely solely on AI output for high-stakes decisions, professional certifications, legal interpretations, financial advice, medical guidance, or other consequential matters.
• SENSITIVE INFORMATION: Do not submit confidential, highly personal, or sensitive information to Mwalimu Assistant unless necessary.

11. Acceptable Use

You agree to use Mwalimu Plug only for lawful purposes and in a way that does not harm the Platform or other users. Specifically, you must not:

• Attempt to gain unauthorized access to Mwalimu Plug or its systems (hacking)
• Circumvent security controls, authentication systems, or access restrictions
• Scrape, crawl, or automatically collect data from Mwalimu Plug abusively
• Introduce malware, viruses, or harmful code into the Platform
• Use Mwalimu Plug for spamming or sending unsolicited messages
• Engage in fraud, identity theft, or impersonation
• Harass, threaten, or abuse other users
• Use automated tools or bots to abuse Platform resources
• Reverse engineer or attempt to derive the source code of Mwalimu Plug software
• Interfere with Platform operations or the services of other users
• Use Mwalimu Plug for unlawful purposes or in violation of applicable law

Mwalimu Plug monitors for prohibited activity and may take appropriate action, including account termination, against users who violate these rules.

12. Intellectual Property

Mwalimu Plug respects intellectual property rights. The Mwalimu Plug branding, logo, website design, mobile application, original platform software, and original Mwalimu Plug-created content are protected by copyright and other intellectual property laws.

You do not automatically receive ownership of Mwalimu Plug's intellectual property simply by using the Platform. You may not copy, modify, reproduce, distribute, or display these materials without permission, except as necessary to use Mwalimu Plug as intended.

Mwalimu Plug does not claim ownership of third-party content, materials, or intellectual property displayed on the Platform. Educational resources created by others remain the property of their respective owners. You are responsible for respecting third-party intellectual property rights.

13. Copyright Complaints

If you believe that content on Mwalimu Plug infringes your copyright or intellectual property rights, please contact us with the following information:

• Description of the allegedly infringing content
• The location of the content on Mwalimu Plug
• Description of your copyrighted work

14. Premium Services and Subscriptions

• Premium access depends on successful payment through our payment provider

You are responsible for maintaining accurate payment information. Mwalimu Plug is not responsible for payment failures due to outdated or incorrect payment details.

Payments for premium services or features may be processed through third-party payment providers, including but not limited to online payment gateways, mobile money services, or card processors.

Mwalimu Plug does not directly store your complete debit card, credit card, or mobile money credentials. Payment information is processed by our payment service providers in accordance with their own security standards and terms.

When you make a payment, you may be subject to the payment provider's terms, conditions, and privacy policy. Mwalimu Plug is not responsible for payment provider services, disputes, or security practices. Contact the payment provider directly for payment-related issues.

16. Third-Party Links and Services

Mwalimu Plug may contain links to third-party websites, applications, employers, news sources, payment providers, app stores, or other services. We may also integrate with or use third-party services to operate features of Mwalimu Plug.

Mwalimu Plug does not control all third-party services and is not responsible for their content, practices, or policies. Before accessing third-party services, you should review their respective Terms and Conditions and privacy policies.

If you experience problems with a third-party service, contact that service provider directly rather than Mwalimu Plug support.

17. Availability of the Platform

Mwalimu Plug aims to provide reliable and stable service to all users. However, we do not guarantee uninterrupted access. The Platform may occasionally be unavailable due to:

• NO GUARANTEE OF EMPLOYMENT: Using Mwalimu Plug does not guarantee employment or job placement. Employers make independent hiring decisions.
• NO GUARANTEE OF RESULTS: Educational resources and AI assistance do not guarantee examination success, academic achievement, or professional promotion.
• INFORMATION ACCURACY: While we endeavor to provide accurate information, we do not guarantee that every piece of content, news article, or resource is completely accurate or current.
• AI LIMITATIONS: AI-generated responses may contain errors. Do not rely solely on AI output for important professional or academic decisions.
• RESOURCE AVAILABILITY: We do not guarantee the availability of every educational resource, job listing, or platform feature at all times.
• CONTINUOUS SERVICE: We do not guarantee uninterrupted service or that Mwalimu Plug will always be available.
• THIRD-PARTY CONTENT: We do not control or endorse all third-party content, news sources, employers, or external services.

TO THE EXTENT PERMITTED BY APPLICABLE KENYAN LAW, MWALIMU PLUG IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

19. Limitation of Liability

To the extent permitted by applicable Kenyan law, Mwalimu Plug's liability is limited as follows:

In no event shall Mwalimu Plug be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Some losses or damages cannot be limited by law (such as personal injury caused by gross negligence). Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded, and such liability remains fully applicable to you.

20. Indemnification

You agree to indemnify, defend, and hold harmless Mwalimu Plug and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms and Conditions
• Your unlawful use of Mwalimu Plug
• Your infringement of another person's intellectual property, privacy, or other rights
• Content you submit or upload to Mwalimu Plug
• Claims by third parties arising from your use of the Platform

This indemnification obligation is subject to applicable Kenyan law and does not apply where you are not at fault.

21. Account Suspension and Termination

Mwalimu Plug may suspend, restrict, or terminate your account and your access to the Platform if:

• We reasonably believe you have engaged in fraud, deception, or dishonesty
• Your account poses a security threat to Mwalimu Plug or other users

Where possible, we will provide notice of suspension or termination and an explanation of the reason. However, in serious cases (such as security threats), we may suspend your account immediately without prior notice.

22. Changes to These Terms

Mwalimu Plug may update these Terms and Conditions when our services, technology, business practices, or legal requirements change. We will post updated Terms on our website and in the mobile application.

Material changes to these Terms will be communicated to you by email or through a prominent notice on the Platform. Your continued use of Mwalimu Plug after changes become effective constitutes acceptance of the updated Terms.

If you do not agree with updated Terms, you may stop using Mwalimu Plug and delete your account.

23. Governing Law

These Terms and Conditions shall be interpreted and governed by the laws of the Republic of Kenya, without regard to its conflict-of-laws principles. Your use of Mwalimu Plug is also subject to applicable Kenyan regulations and laws.

Nothing in these Terms shall be interpreted to waive any rights you have under mandatory Kenyan consumer protection law or data protection law.
